By taking part in this Contest (as defined below) you accept and agree to be bound by these Official Rules and agree that all decisions of Sponsor are final and binding. These Official Rules apply only to this Contest and not to any other promotions, contests, sweepstakes, or giveaways sponsored by New Era.
SPONSOR: This Contest is sponsored by New Era Cap, LLC, located at 160 Delaware Avenue, Buffalo, NY 14202 (“New Era” or “Sponsor”).
CONTEST PERIOD: The NEW ERA RACING CHALLENGE (the "Contest") takes place at the Lids Las Vegas Flagship Store, located at 3791 S Las Vegas Blvd Suite 1400, Las Vegas, NV 89109 (the “Event Location”), from 12:00 p.m. through 4:00 p.m. (PST) (“Event Hours”), on Friday, November 22, 2024 ("Day 1") and Saturday, November 23, 2024 ("Day 2") (Day 1, Day 2 and Day 3 shall be referred to collectively herein as the "Contest Period").
ELIGIBILITY, RESIDENCY AND AGE: The Contest is open only to legal residents of the United States (each, a “Participant”). Employees, officers, representatives or agents of Sponsor, the Released Entities (as defined below) and their respective affiliated entities, agencies and production agencies, and their immediate family members (spouse, parents, siblings, children, in-laws, grandparents, grandchildren), are not eligible to enter. This Contest is subject to all federal, state and local laws and regulations. VOID WHERE PROHIBITED, TAXED OR RESTRICTED BY LAW.
HOW TO ENTER THE CONTEST: For a chance to participate in the Contest, all Participants must visit the Event Location between 9:00 a.m. on Friday, November 22, 2024, and 4:00 p.m. on Saturday, November 23, 2024, and either: (i) make a New Era headwear and/or apparel product (hereinafter, “Product”) purchase and receive, from a Lids store representative and/or a New Era representative, one (1) ticket per Product purchased; or (ii) request a ticket, with no purchase necessary, from a designated Lids store representative and/or New Era representative, provided that no such free ticket shall be distributed to Participants that made a Product purchase.
At New Era’s activation area located within the Event Location and during the Event Hours, each Participant must, for a chance to participate in the Contest: (i) present such Participant’s ticket to a Lids store representative and/or a New Era representative; and (ii) complete all required information (including, without limitation, name, email address and phone number) on an entry form and return the completed entry form to the Lids store representative and/or a New Era representative (each, an “Approved Participant”). All entry forms become the sole property of the Sponsor and receipt of all entry forms will not be acknowledged or returned. Sponsor is not responsible for lost, late, incomplete, illegible, mutilated, invalid, unintelligible, or misdirected entry forms; all such entry forms will be disqualified. No facsimiles, mechanical reproductions, alterations or forged entry forms are permitted. Sponsor makes no guarantee that all such Approved Participants will be eligible to participate in the Contest. The Contest will be held on a first-come, first-served basis and any such Approved Participants deemed eligible to participate in the Contest will be at New Era’s sole discretion.
Throughout the Contest Period, entrance to the activation area located within the Event Location prior to the Event Hours is prohibited. Each eligible Approved Participant will compete, using such Approved Participant’s designated remote-controlled car assigned by Sponsor and/or its representative(s) in the sole discretion of Sponsor and/or its representative(s), to finish the race in the fastest time out of all other Participants competing in the same race. Each race will, and must, consist of at least four (4) Participants, unless otherwise determined in the sole discretion of Sponsor and/or its representative(s), and such race shall consist of a total of four (4) laps around the racetrack using such Approved Participant’s assigned remote-controlled car (each a “Race”). Once the Approved Participant’s assigned remote-controlled car completes four (4) laps around the racetrack, no further laps around the racetrack will be counted. Any such Approved Participant’s final score will be determined by such Participant’s fastest Race time.
One (1) Race per ticket. Restrictions apply. All Races are held on a first-come, first-served basis and no such Races shall be held after 4:00 p.m. on Day 1 or Day 2. Approved Participants unable to participate in a Race on Day 1 may present his/her/they ticket on Day 2 for a chance to participate in a Race.
Day 1:
On Day 1, the top twenty-five (25) Approved Participants who won their respective Races with the fastest final scores as of 4:00 p.m. (PST) will be entered into a randomized drawing to win one (1) Grand Prize.
Day 2:
On Day 2, the top twenty-five (25) Approved Participants who won their respective Races with the fastest final scores by 4:00 p.m. (PST) will be entered into a randomized drawing to win one (1) Grand Prize.
All fastest final scores will be captured, recorded and stored digitally and only Lids store representatives and/or New Era representatives shall have access to such fastest final scores throughout the Contest Period. In the event the top twenty-five (25) Approved Participants who won their respective Races with the fastest final scores on Day 1 and/or Day 2 cannot be determined because there is a tie between two (2) or more Approved Participants on the same day during the Contest Period, those tied Approved Participants will also be entered into the random drawing on that particular day (e.g., tied Approved Participants on Day 1 will be entered into the random drawing for the Grand Prize on Day 1, tied Approved Participants on Day 2 will be entered into the random drawing for the Grand Prize on Day 2). Notwithstanding anything to the contrary herein, Lids Premium Access Members who make a Product purchase and attempt a Race during the Contest Period and during the Event Hours at the Event Location, regardless of their time, and complete all required information (including, without limitation, name, email address and phone number) on an entry form and return the completed entry form to the Lids store representative and/or a New Era representative, will automatically be entered into the random drawing and become eligible to win one (1) Grand Prize. For the avoidance of doubt, all Approved Participants entered into the drawing to be randomly selected for a Grand Prize shall be referred to herein as a “Race Winner” or as “Race Winners”.
SELECTING THE CONTEST WINNERS:
Day 1:
At or about 4:00 p.m. (PST) on Day 1, all Race Winners from Day 1 will be entered into a random drawing whereby one (1) Race Winner will be randomly selected to win two (2) West Harmon Zone Tickets to the Formula 1 Heineken Silver Las Vegas Grand Prix on Friday, November 22, 2024 at 6:30 p.m. (PST), as determined by New Era in its sole discretion.
Day 2:
At or about 4:00 p.m. (PST) on Day 2, all Race Winners from Day 2 will be entered into a random drawing whereby one (1) Race Winner will be randomly selected to win two (2) West Harmon Zone Tickets to the Formula 1 Heineken Silver Las Vegas Grand Prix on Saturday, November 23, 2024 at 10:00 p.m. (PST), as determined by New Era in its sole discretion.
PRIZES:
Day 1:
The Grand Prize for Day 1 will be two (2) West Harmon Zone Tickets to the Formula 1 Heineken Silver Las Vegas Grand Prix on Friday, November 22, 2024, at 6:30 p.m. (PST), as randomly selected and determined by New Era in its sole discretion.
Day 2:
The Grand Prize for Day 2 will be two (2) West Harmon Zone Tickets to the Formula 1 Heineken Silver Las Vegas Grand Prix on Saturday, November 23, 2024, at 10:00 p.m. (PST), as randomly selected and determined by New Era in its sole discretion.
Grand Prize winner(s) are responsible for any and all other expenses related to its acceptance of any prize. Grand Prize winner(s) are also responsible for all federal, state and local taxes, including completion of W-9 taxation forms. The odds of winning any prize may depend on the number of eligible entries during the Contest Period, the skill of the entrants, and other variables such as the number of available prizes and timing or selection of Approved Participants.
NOTIFICATION TO WINNER: The winners of each Grand Prize will be notified by a New Era representative, via email, text message and/or phone call using the information provided by such Approved Participant upon entry into the Contest, immediately following the selection of his/her/its name in the random drawing on or about 4:00 p.m. on Day 1 and Day 2. If a potential winner cannot be reached, in the sole discretion of New Era and/or its representative(s), by 4:30 p.m. (PST) via email, text message or phone call, or in the event a winner does not accept a Grand Prize or fails to comply with these rules and requirements, such Grand Prize will be forfeited. Upon any such Grant Prize forfeiture, no compensation will be given and New Era will have sole discretion to select another winner. Any such Grand Prize is non-transferable; a Grant Prize cannot be substituted for another Grand Prize; a Grany Prize cannot be sold; and a Grand Prize cannot be redeemed for cash from Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value in the event that a Grand Prize is unavailable. The winner and any guest(s) shall be required to complete and sign a Winner’s Affidavit (as outlined below) and/or other documents if required by Sponsor when such winner claims his/her Grand Prize. Failure by the winner to sign any requested documents or failure by the winner to comply with any terms in these Official Rules may disqualify the winner in New Era’s sole discretion and winner may forfeit his or her interest in such Grand Prize.
CLAIMING THE PRIZE: To claim any Grand Prize, winners (and his/her guest, if applicable) must each sign and return to the Sponsor within one (1) hour of being contacted by Sponsor a Winner’s Affidavit, or in the event the winner is a minor, a Minor Winner’s Affidavit must be completed by the winner’s parent or legal guardian. For the avoidance of doubt, in the event the winner is a minor and he/she/it does not have a parent or legal guardian complete the Minor’s Winner’s Affidavit in the specified time, it shall be deemed a failure by the winner to comply with the terms in these Official Rules and Sponsor may disqualify the winner in its sole discretion and winner may forfeit his or her interest in any such Grand Prize.
GENERAL CONDITIONS: This Contest is intended for participation in the United States only and shall be construed only according to United States law. Participants agree the Contest is governed by New York state law.
By entering the Contest, entrants agree to be bound by these Official Rules and agree: (1) the Sponsor and each of its respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents and assignees may use (unless prohibited by law) the entrant’s name, voice, city/state of residence, photograph, and visual and/or audio likeness for advertising and/or trade purposes, and for any other purpose in any media or format now or hereafter known without further compensation, permission or notification; and (2) to release and hold harmless Sponsor and each of its respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, or participation in this Contest, or possession, acceptance and/or use or misuse of any such Grand Prize or participation in any Contest-related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor and each of its respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents and assignees shall be collectively referred to as the Released Entities.
ADDITIONAL TERMS: Any other attempted form of entry not specified herein is prohibited; no automatic, programmed, robotic or similar means of entry are permitted.
Sponsor, the Released Entities and each of their respective affiliates, partners and sweepstakes and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, which may occur in the distribution of prizes (including, without limitation, any Grand Prize) in this Contest.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Contest should it determine, in its sole discretion, non-authorized human intervention or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor will select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor.
Potential winner(s) may be subject to a background check of any and all records at Sponsor’s sole discretion, including without limitation, civil and criminal court records and police reports, and entry into this Contest constitutes consent for Sponsor to conduct such background check. Winner(s) may be disqualified at the sole discretion of the Sponsor for any of the following reasons: (i) if charged with or convicted of a felony or misdemeanor; (ii) if not eligible based on the eligibility requirements set forth in these Official Rules; (iii) if delinquent on a government ordered payment, including, but not limited to, child support, spousal support, alimony or tax payments; (iv) violates the law(s) of any jurisdiction; and/or (v) engages in any activity or behavior which offends the public morals or embarrasses or puts the Sponsor in a negative light.
Any false information provided within the context of the Contest by any entrant concerning identity, age, eligibility, mailing address, telephone number, email address, ownership of right, or non-compliance with these Official Rules or the like may result in the immediate elimination of the entrant from the Contest.
Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest. Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.

Requests for a list of Grand Prize winners must be received no later than Saturday, November 23, 2024.
